Auto-Guard APP User Agreement

Important Notice: Please read this Agreement carefully. By registering an account, clicking “Agree,” or otherwise using the Auto-Guard mobile application , referred to as “the Platform”), you acknowledge that you have read, understood, and agreed to be bound by this Agreement. If you do not accept any provision of this Agreement, you must not use the Platform or its services.

This Agreement is entered into between GASTOR PTY LTD (registered in Australia, hereinafter referred to as “the Company,” “we,” or “us”) and the user of the
Platform (hereinafter referred to as “you” or “User”).

1. Definition

1.1 This platform “refers to the operation of GASTOR PTY LTD , and the domain name is” www.auto-guard.com.au “, Provide equipment management, data display, command.

Delivery and other services 

1.2 Service: Refers to the functions provided by the platform, such as device location, trajectory, sensor data viewing, command delivery, alarm reception, etc

1.3 Equipment: Refers to locator products that need to be used in conjunction with this platform

2. Service Content and Scope

2.1 Service content: including real-time device location, historical trajectory, sensor data, instruction issuance, and alarm reception

2.2 Supporting Equipment: Only devices sold or supported by our company are supported, and unpaid devices cannot be connected

2.3 Platform changes: Our company may change, upgrade, suspend or terminate some functions

3. User Account and Registration

3.1 Registration Requirements: Users must have full capacity for civil conduct

3.2 Registration Method: Email

3.3 Authenticity of Information: Registration information must be genuine and valid, and the platform does not require real name authentication

3.4 Account Security: Users should keep their account passwords safe and promptly notify our company if there are any abnormalities

4. User Rights & Obligations – Rights: Users are entitled to lawful access to Platform services. – Obligations: Users must comply with applicable laws and refrain from uploading irrelevant or unlawful content. Users must not engage in illegal, infringing, fraudulent, or disruptive
activities. Violations may result in suspension or termination of services and liability for damages. – Prohibition: Users are prohibited from making false claims or defamatory statements against the Platform or the Company.

5. Company Rights & Obligations – Commitment: The Company shall provide stable services, except where interrupted by
force majeure. – Maintenance: The Company may perform system upgrades and maintenance as needed. – Enforcement: The Company reserves the right to manage non-compliant accounts or devices, including suspension or termination of services.

6. Data Collection & Privacy (GDPR Compliance) – Purpose & Legal Basis: User data is collected and processed for service delivery, legitimate
interests, compliance with laws, or based on user consent. – Data Collected: Includes device location, login details, voluntary user inputs, usage logs, and cookies. – Storage & Transfer: Data of Australian users is stored in Singapore. All data is protected by industry-standard encryption and security controls. – User Rights: In accordance with GDPR, users have the right to access, correct, delete, or restrict/oppose processing of their personal data; request data portability; reject automated decision-making; and lodge complaints with supervisory authorities. – Cookies: Used to improve user experience. Users may manage cookie preferences in their browser.
– Consent: Users may withdraw consent at any time without affecting the lawfulness of prior
processing. – Third Parties: Partner organizations (e.g., cloud service providers) are required to comply with GDPR standards.

7. Intellectual Property All content and technology on the Platform, including databases, website design, software, text, graphics, images, music, videos, and source code, are owned by GASTOR PTY LTD. Unauthorized use, reproduction, or distribution is strictly prohibited.

8. Auto-Guard, are car security products provided by Gastor Pty Ltd ABN 27 651 602 783 ( ‘Gastor’), a Corporate Authorised Representative (CAR) of Australian Warranty Network Pty Ltd ABN 785 075 483 206 trading as AWN Insurance (‘AWN’) [AFS License
No: 246469]. Gastor is authorised to provide miscellaneous financial services in relation to the excess reimbursement product only on behalf of AWN”.

9. Disclaimer
The Company shall not be liable for any losses caused by force majeure events, network failures, hacking, or issues attributable to the user. Users must independently assess the risks of using the Platform.

The Platform and its content are provided “as is.” We make no express or implied
warranties regarding: uninterrupted or error-free operation; compliance with user requirements; correction of defects; absence of viruses or harmful components; or confidentiality of transmitted data.

10. Liability for Breach – User Breach: In the event of a breach by the user, the Company may suspend or terminate services and seek compensation for damages, including but not limited to direct financial losses, third-party claims, and dispute resolution expenses (e.g., legal fees, litigation costs,
travel expenses, and investigation costs). – Company Breach: If the Company breaches this Agreement, users may exercise their rights under applicable law.

11. Amendments & Termination
The Company may amend this Agreement with prior notice. Continued use of the Platform constitutes acceptance of the revised terms. Users may terminate use at any time. The Company may unilaterally terminate this Agreement in cases of material breach or cessation of business operations.

12. Governing Law & Dispute Resolution
This Agreement shall be governed by the laws of Australia. Disputes shall be resolved through negotiation; if unsuccessful, disputes shall be submitted to the competent People’s Court where the Company is located.

13. Miscellaneous – Invalidity: If any provision of this Agreement is deemed invalid, the remaining provisions
shall remain in effect. – Headings: Section headings are for convenience only and do not affect interpretation. – Effectiveness: This Agreement becomes binding when the user clicks “Agree” during registration and successfully creates an account.
